An expert in his field, Brett was admitted to practice in 1997, and since that time has focussed purely on insurance law, acting on behalf of insurers, brokers and self insured organisations.

Experience

Brett has been a Partner since the early 2000s,  and has practiced purely in insurance law since beginning his career in 1994. He grew with Barker Gosling (which morphed into DibbsBarker), before co-founding HBA Legal in 2011.

An expert in his field, Brett has acted for large insurance companies and Australian companies, and self-insured organisations, the bulk of this lying in State Workers Compensation, Federal Compensation, public liability, motor vehicle claims and administrative law. He has acted for licensed employers under the Federal Compensation Scheme since 1997, and as Counsel in AAT and Federal Court matters.

Experience

Ruth has practiced almost exclusively in defendant based insurance litigation since 1992. She joined HBA Legal in January 2015 from a career covering practice at Clayton Utz, Downings Legal (aka Barker Gosling) and Crisp Civitella Slater (now CCS Insurance Law), acting for numerous insurers and self insureds. She also has six years concurrent experience in the Comcare system providing legal advice on workers’ compensation claims to large companies.

Chris joined HBA in early 2016 to found its Brisbane office. Dr Andrew Lu OAM leads HBA’s health law practice. He has substantial experience representing the insurance industry, health practitioners, and Government on contentious matters.    Andrew began practice as a commercial insurance litigator with Freehills, and for nine years managed general liability, financial lines and professional indemnity disputes as a senior member of the insurance and risk team of Minter Ellison. Here,  he developed a special interest in medical negligence, before becoming a partner of Jarman McKenna.

Andrew has conducted administrative law litigation, mediated vocational and commercial matters to early resolution, and advised Government and corporate clients on contractual disputes, the conflict of laws, and tortious claims.  He holds masters and doctoral degrees in Law and is a Fellow of the Australian and New Zealand Institute of Insurance and Finance.  Andrew promotes good governance in the Arts as a non-executive director of the National Gallery of Australia Foundation and the Arts Law Centre of Australia.

Andrew provides public and private hospitals and health practitioners with strategies to achieve the best outcomes in professional, public and products liability claims, and in vocational regulation and disciplinary investigations. Defendant personal injury litigator, Toby Whyte, was appointed HBA’s first Special Counsel in August 2018 – a title reflecting her two decades of experience in personal injury cases.

Toby joined HBA from a career covering practice at Moray & Agnew, Jarman McKenna, K N Allan, Talbot & Olivier and Jackson McDonald.

She specialises in defendant personal injury litigation, including motor vehicle claims and treatment liability, and has more than 15 years’ experience providing legal services to the Insurance Commission of Western Australia.

Toby graduated from the University of Western Australia in 1998 with a Bachelor of Laws and Bachelor of Arts and was admitted to legal practice in 1999. She is a member of the Australian Law Insurance Association, the Law Society of Western Australia and the Western Australian Society of Jewish Jurists.

Toby is renowned as being one of Perth’s best defendant personal injury litigators, particularly when it comes to motor vehicle claims. She also works across HBA’s Medical Malpractice and Health Law division resolving vocational and disciplinary matters regarding health practitioners and at inquests involving doctors and hospitals.

One of Toby’s key strengths is the commission and analysis of expert medical evidence, particularly in relation to complex medical causation issues often involving pre-existing conditions and concurrent injuries. Experience

With over eight years’ experience in personal injuries claims management within Allianz Australia’s CTP Department, Elizabeth joined HBA shortly after being admitted to legal practice. As a Team Leader at Allianz, Elizabeth managed claims from the date of lodgement through to resolution.

Elizabeth has a Bachelor of Science from Macquarie University (2008), a Graduate Diploma of Law (2016) and Practical Legal Training qualification from the College of Law (2017). She was admitted as a practicing solicitor in April 2018.

Areas of Expertise

Elizabeth came to HBA with a wealth of knowledge in personal injury claims, compensation to relatives claims and recovery claims brought pursuant to section 151Z of the Workers Compensation Act 1987 (NSW). She is experienced at analysing medical issues, assessing causation, quantifying claims and setting strategies, as well as drafting submissions pertaining to the Motor Accidents Compensation Act 1999 (NSW) and the Civil Liability Act (NSW). One of her core strengths lies in the ability to arrive at liability determinations pursuant to section 81 of the Motor Accidents Compensation Act 1999 (NSW), which requires the analysis of the accident itself, as well as the injuries alleged to have been sustained.

Elizabeth is skilled at negotiating settlement of claims and her background in Science gives her the technical edge when it comes to factual investigations, as well as medical causation.

Yen joined our team in May 2018 with solid experience in both legal advice and preparing risk management workshops. Simone has worked as a legal secretary and paralegal in insurance since achieving her Diploma of Legal Services in 2005.  Prior to joining HBA in mid-2015, she spent several years at DibbsBarker, and also spent a year as a barristers assistant in 2011.

Simone supervises HBA’s administration team in its Sydney office, helping develop new  policies and procedures in keeping with the firm’s innovative approach to practice.  Simone has wide spread duties across the board, including managing client functions, and supporting the HR Manager in the care of HBA people.
