Resources, Property & Construction

HBA has developed a strong practice in resources, property and construction based on many years experience. In addition to dealing with claims, we are regularly asked to advise insurers and their insureds in relation to coverage disputes and policy interpretation matters. We also have specific expertise in the areas of property damage and business interruption losses and are familiar with wordings in contract works and ISR policies.

We maintain a particular focus on matters arising in the construction, mining and engineering sectors and have experience across a number of significant projects throughout Australia and offshore. We advise on recovery and subrogated claims and have a particular interest in the applicability of indemnity provisions in contracts.

HBA‘s experience extends to a major waterfront development project, a European based waste processing plant, and an off shore oil spill involving complex dual insurance issues. We are also regularly retained to advise major utility providers.

Logistics and Operations

HBA regularly acts on behalf of large Australian logistic companies and our experience has shown us that our legal advice and solutions needs to be tailored to a fast moving, site specific environment where resolution of claims is paramount. Down time in any business can be detrimental however, in a logistics business which relies on all parts of the supply chain performing efficiently and effectively, reduction in duration of claims is critical.

Medical and Health

HBA has become well recognised for its expertise and experience in the field of medical malpractice and health law. It is a key part of our practice.

We represent and defend both public and private hospitals and health care professionals in a wide range of matters across the medical practice field. In particular, we deal with claims in the areas of gynaecology and obstetrics, oncology, mental health, paediatrics and general surgical matters. We also act on behalf of specialists in related fields such as physiotherapists, psychiatrists and radiologists.

Where appropriate we work closely with practitioners to ensure we can deliver the best defence and support, being fully conversant with the facts and circumstances of every matter we are involved in. HBA defends large supermarkets, hotels and retail environments against liability claims brought by injured customers and patrons. We appreciate that injured people are valued customers and understand the importance of that relationship. As such, we manage reputational risk alongside complex client/customer relations when running litigation. Our bespoke approach ensures we act swiftly and smartly with the most appropriate solution for each case. This may mean we identify early opportunities to resolve the claim quietly, to ensure minimal losses for low margin industries, it may mean an aggressive defence of a spurious claim (again with reputation management front of mind).

We understand the biggest issue for our clients is the cost and duration of claims. We minimise both by cutting to the chase and remaining unimpeded by red tape and bureaucracy.

Acting for local, national and overseas underwriters, in addition to dealing with claims, we are regularly called upon to advise in respect of indemnity and coverage issues. We appreciate and understand the importance of relationships in this area. In particular, the valuable commercial relationships between insurers and their clients. For that reason we ensure we adopt a team approach to ensure those relationships are maintained and where possible enhanced.
